Why do you need title insurance?

If you have ever purchased a home through a real estate agent and with a mortgage, then you have seen a title compromise. This is a “health certificate” from a title insurance company, telling you who owns the property you are buying and any liens, mortgages, or liens on the property. It is essential that you obtain a title commitment and title insurance.

A typical sales agreement requires the seller to give the buyer a “guarantee” deed. The word “guarantee” means that the seller is guaranteeing to the buyer that he owns the property, which consists of the legal description set forth in the title commitment, and that liens, liens, and mortgages will have been released at closing time for that ownership be transferred without any baggage. Also, if the sales agreement was signed by one person but the title commitment indicates that there are two owners of the property, both owners must sign the closing documents for the sale to be consummated. If the property belongs to an estate (because the owner is deceased), the personal representative may need to obtain a court order to obtain the authority to sign a deed on behalf of the estate. If the property is owned by a corporation, then a majority of the shareholders must consent to the sale through a corporate resolution for the sale to be effective.

When there is no title insurance to guarantee legal description, legal ownership, and the absence of liens at closing, the buyer usually obtains a “get out of claim” master deed. This means “buyer beware” in spades. The buyer can later file a fraud lawsuit against the seller, but that means a lawsuit and potential problems with collecting a judgment. If, on the other hand, you have title insurance and find that the legal description was incorrect, the seller had no right to sell the property, and/or the liens or other liens were not disclosed or released, you can file a claim for sure and hopefully it will pay off almost immediately.

When you buy a property, especially if it has been foreclosed on or if you are buying it as a “short sale,” be sure to obtain a title insurance commitment. The compromise provides guidance on what must be done to remove liens, encumbrances, and mortgages from the public record. The commitment, however, can “expire”. There is a date, usually at the top, indicating the last date the title of the property was verified. You can request that the title commitment be “updated” to the date of the sale. If not, and you agree to a past due date commitment, you may not be able to file a complaint if the IRS filed a lien against the property the day before the sale and the title company did not discover it. Since title insurance companies are connected these days with the Registrar of Deeds office, it is not a burden for them to do a last minute check.

As a final matter, when the property has been repossessed, there is a “redemption period” (usually six months) after the sheriff’s sale during which the owner can “redeem” the property. To redeem, the owner must go to the Registrar of Deeds office with a cashier’s check for the amount paid at the sheriff’s sale plus interest that has accrued since the sale. If the owner is able to sell the property during this redemption period, that can generate enough money to redeem the property. The problem is that if the property is redeemed, any mortgages or liens that were recorded after the foreclosure was recorded are reinstated and remain attached to the property.

For example, suppose the following:

On January 5, 2008, Bank of America recorded a $100K home loan for the homeowner.

On September 9, 2009, Quicken Loans posted a $50K secured principal facility.

On March 2, 2010, the IRS filed a lien for $100K.

If (a) Bank of America foreclosed on the $100K home loan; (b) Bank of America “bid” $100K at the sheriff’s sale (and then offered to forfeit the mortgage in exchange for the property); and (c) the owner did not redeem the property, then the subsequent Quicken Loans loan and IRS lien will be extinguished. Bank of America will be the sole owner of the property.

If, on the other hand, a) Bank of America foreclosed on the $100K home loan; (b) Bank of America “bid” $100K at the sheriff’s sale (and then offered to forfeit the mortgage in exchange for the property); and (c) the owner redeemed the property; then, the subsequent loan from Quicken Loans and the IRS lien remain a lien against the property. If someone purchased the property during the redemption period, even at a short sale, that person would have paid the owner something to purchase the property, but would have actually purchased the property still subject to the $50K secured equity line and lien. from the IRS of $100K. Only the full execution of the redemption period extinguishes subsequent liens, mortgages, and encumbrances unless subsequent lenders or lien holders agree to release their interest in the property. If you are still dealing with the owner of the repossessed property, the property is most certainly still in the redemption period and therefore YOU MUST BE CAREFUL!

It is imperative that real estate buyers obtain title insurance and the wisdom of a good title insurance company. As they say, “If it’s too good to be true, then it probably isn’t.” While in most real estate deals the seller pays for the title insurance, there is nothing to prevent the buyer from obtaining title insurance on their own. At a minimum, a buyer must obtain a title search on the property (current on the date of sale) prior to any purchase.

How to fix a paper jam on the Samsung SCX-5530FN

The following instructions will help you if the message that appears shows PAPER JAM 0 Open/Close Door on the Samsung SCX-5530FN.

Jam Location: In the paper feed area (Tray 1, Optional Tray 2*, or Multi-Purpose Tray): Note that the optional Tray 2 is a secondary paper tray and may not be installed.

Follow the steps to remove paper jammed in these areas.

(A) Paper jammed in paper tray 1

When paper jams in the feed areas, the message [Paper Jam 0] Door open/close will be displayed on the LED panel.

STEP ONE

Pull the paper tray completely out of the cassette (IMPORTANT: After removing the tray, the paper may look like the image opposite. DO NOT try to remove it at this time!)

SECOND STEP

Completely remove the toner cartridge. (Note: The cartridge contains both the toner and the “imaging drum”. The drum is light sensitive and should be covered while out of the copier.)

STEP THREE

Locate jammed paper in this area.

STEP FOUR

Grasp the jammed paper at both corners and gently pull toward you until the paper is completely clear.

When you have completely removed the paper, insert the toner cartridge back into the machine and close the front door.

It is important to remove all jammed paper and any torn debris. If it is not completely removed, the jam message will remain.

If the jammed paper hasn’t advanced far enough for you to grab it, then do the next step!

1. Press down firmly on the round metal bar and turn it counterclockwise until enough paper feeds through for you to grab.

2. Follow step four

If after following step 4 “Jam 0” still appears on the LED display, check that there are no paper scraps left in the paper path.

STEP ONE

The machine must be placed on its back, BEFORE doing this, tape the ADF cover so it will not be damaged when the copier is placed on its back.

Pull out the paper tray.

SECOND STEP

Disconnect the power cable and 2 input cables.

STEP THREE

With the machine laying on its back, look for any trapped paper scraps in the highlighted area in front!

Note: The paper tray MUST be removed!

Any torn paper MUST be removed for the ‘Jam 0’ message to clear.

When you have removed the paper, return the machine to its operating position, reconnect the power and input cables, insert the paper tray, and start printing.

2008 Houston Texans preliminary report

The Houston Texans have yet to win a Super Bowl, a conference championship, or even a division title. On the other hand, you should also remember that the Houston Texans have a relatively short history, having first formed in 2002. The Texans not only got some great talent this year, but also filled some missing needs in the way of left tackle, cornerback and running back positions. Antwaun Molden and Steve Slaton were also fan favorites as they boosted the team’s athleticism, Slaton in particular being targeted for “big plays”.

Xavier Adibi also turned heads by scoring 115 tackles, with three sacks and 12 tackles for loss; he then further impressed the Texans with his pro performance, running the grand 40 in under 5 seconds. Naturally, management was interested in Adibi’s athleticism, quickness and ability to change directions easily. Okam must have been a sentimental victory, since this player was already in Texas playing for the Longhorns. His size, impressive at 6-foot-5 and 300-plus pounds, certainly provides a defensive edge the team previously lacked.

Barber was also listed as a favorite thanks to his natural ability, perhaps genetically gifted, as he is the brother of Dallas Cowboys pro bowler Marion Barber and the son of former New York Jets running back Marion Barber Jr.

Texans have every reason to be excited as the year kicks off as they look forward to making this their best season yet.

The power of the spoken word: a life lesson for my daughter

Last Monday was a perfect summer night in Chicago. Not a cloud in the sky with warm temperatures and a light breeze blowing off the lake kept it tolerable and away from the humidity.

I had slept late that morning and felt well-rested after a two-week trip. I was scheduled to leave again in a few days and intended to spend some downtime with my husband and daughter.

There is a lot of activity in Chicago during the summer. It’s the summers that make up for the sometimes harsh and unforgiving winters and one of the reasons I still call Chicago home.

What better place to experience the city tonight than the ‘Taste of Chicago’.

We arrived at the downtown venue around 6:45 pm, just before the evening rush hour. We could listen to the musicals of the ‘Broadway in Chicago’ performance on the main stage.

My husband and I had done a 4 mile run that morning so I was prepared and hungry. After purchasing our meal tickets, I headed straight to the Nigerian kiosk that served coconut rice, stewed goat meat and fried plantains. There’s nothing like a good cooked ‘soul food’.

Wiping my hands after finishing, we wandered in and out of the ‘window shopping’ crowd for dessert. There were seagulls flying low around us.

‘I wish these birds would stop flying over me. I don’t want to be pooped on! my daughter exclaimed in disgust.

“Careful what you say, they might poop on you,” I answered absentmindedly as I looked around the crowded stalls for a a single turn we serve

My husband decided to have a can of beer. We had run out of tickets. He was still looking for the ‘Once in life’ dessert. So we go to a locker to buy more.

We were about to get in line when my daughter let out a bloodcurdling scream. Alarmed, we both turned around to see what had happened to him.

There, on the left side of his neck, was a neat white drop of bird droppings!

I couldn’t control my laughter! She there she was furious, now trying to crush the wandering birds with her bag. I had a piece of tissue left over from my dinner. I deftly wiped her neck amidst my giggles.

‘I told you to be careful what you say,’ I admonished her playfully as I explained to my husband the earlier exchange I had with her on the same subject.

You see, what my daughter had just experienced firsthand was an example of the power of the spoken word.

It was exciting for me that she could see firsthand that she had the power to manifest what she intentionally or unintentionally intended..

This was a great teaching moment for us as a family.

‘Think of the power you have to create whatever you want in your life!’ I exclaimed excited. Being the teenager that she is, she simply rolled her eyes.

Yes, we all have the power to create anything we want to create in our lives.

That power resides in a part of our mind called unconscious mind. And as my daughter discovered in our ‘lab of life’ experiment, the subconscious mind doesn’t have a great sense of humor!

Whatever you suggest to the subconscious mind, it sets out to make your reality..

And it can get bogged down by constant negative mental chatter and clutter.

Do you pay attention to what feeds your mind?

As I shared in a previous article on mental poisoning what you focus on you bring more into your awareness.

It always intrigues me when I hear patients say things like ‘I knew I was going to get sick after that person sneezed on me!’

And guess what? The subconscious mind is like the ‘genie in the bottle’ When you consciously or unconsciously declare that you are going to get sick, well, your wish is the command to get sick!

Some people find it intriguing that despite my job as a locum tenens doctor with trips to different hospitals and hotel stays for weeks, I don’t get sick Sometimes I work up to an 80-hour week.

I am not saying this to impress you, but to impress upon you that I major my subconscious mind with thoughts of health, vitality and vitality.

We all have the power to do the same things with our subconscious mind. We just have to make a conscious choice. I don’t mean to make this sound so simple, as I know some readers may think I’m just saying ‘just say it and it will happen the way you say it will happen’.

The power of the spoken word in the subconscious mind is a summation of how you have trained your mind to interpret past experiences.

Using my daughter as an example. This is how our beliefs are primed in us at a young age:

If like his father, my belief where the bad things are forever it was meant to happen, so the bird pooping on her was just another Self-fulfilling prophecy. And I probably would have reacted differently to reflect my belief. It would have validated what my experience has been, fueled her disgust. That would have left her with the innate message that bad things will always happen as we should expect.

Instead I would like to see the possibility and potential!

Possibility because she has stated that she wants to do great things in the world as a singer-songwriter. If she says she’s going to be one, who’s anyone, including me, to say that can’t happen?

Needless to say, neither the bird nor my daughter suffered any harm. I trust you will remember this lesson and realize that you have the innate power to create a bright and wonderful future. because she said so.

Here are some things to consider and also practice this week:

If you knew you couldn’t fail, what would you do?

Practice statement with little things all week. For example, you will find a parking space when you need it, a friend will be available to talk when you need it. Just practice!

Next week, get bolder and practice declaring more important things, like that you’ll have a certain amount of money to meet a financial obligation or that you’ll get a promotion at work.

Don’t get attached to the results of these exercises.

Why do I want my tubes tied?

This Monday I’m going to have my tubes tied. I am 29 years old and my tubes are being tied. It’s happening. I’ve had some mixed reactions from people, so I thought I’d explain my reasoning behind this decision.

1. My mental health:

I struggle with some serious mental health issues that have plagued me since I was 15 years old. I just found a combination of medications that keeps me stable, happy, and able to live my life. When I’m not taking my medicine, I’m crying all the time, angrier, a lot more impatient, and just generally not a fun person to be around. When I get pregnant, I go crazy. Medications need to be adjusted and hormones need to be treated. Then after pregnancy I am prone to postpartum depression which makes those 6 months of my life a roller coaster of nonsense. It’s a bunch of crazy stuff that strains my relationships with others and makes my life miserable. That was the main reason for my decision.

2. My birth control failed me once:

I was on birth control when I got pregnant with baby Wallace. He must have really needed to come into the world. So now I’m a lot more wary of traditional birth control. I know the chances of it happening again are overwhelmingly slim, but I’d rather not take that risk.

3. The M-word:

We can’t afford any more children. Money is a factor in most of our life decisions and we honestly don’t feel like it would be fiscally responsible for us to have another child. That is our situation. I’m sure it would probably work if we felt strongly that we needed to have another but, as you can already guess, I haven’t had that strong feeling.

4. It feels good to me:

I’m not saying that every 29 year old should run out and have this procedure, I’m saying that it is what I feel is right for me and my body. Pregnancy is difficult for me, mentally and physically. None of my pregnancies have been easy, and this last one was especially difficult. I really wanted soft pregnancies, but they just weren’t in my cards.

Don’t get me wrong, I love my kids. I am grateful to everyone in my life, both here and in heaven. I wouldn’t leave them for the world. But I feel like they are my world now and our family is complete. I feel no anguish or shock at this decision. I feel relieved and excited for the next chapter of my life. I feel like I can jump into parenting knowing I don’t have to wonder if I’ll ever have to go through the pain and stress of another pregnancy. It’s actually quite a liberating feeling.

In my opinion, it is probably the most satisfying stage and the results are out of this world. It’s still a 2-day split, using the same muscle pairing as stage one. Exactly the same aerobic programs are used once again. The diet is once again flexible and depends on whether or not you have any body fat to get rid of.

Stage 3- Muscular strength along with Definition

Right here is the 2 month cycle where you are going to cut a lot. It is the most difficult phase since more cardiovascular exercise is added and the diet program is very strict. You’re really going to need to motivate yourself when you’re at this stage. The split is ordered differently at this stage and the rep range will be 2-4. The split is:

Day One: Chest Muscles, Back, Abs

The second day will be the muscles of the shoulders, triceps and biceps.

Cardio uses tactical cardio, which is a combination of HIIT training accompanied by 30 minutes of steady cardio.

The diet for this cycle is quite rigid, focusing on high protein, reduced fat, and low carb. In this phase, you follow the principles of intermittent fasting and the idea is to be in fat-burning mode on a regular basis by not raising blood insulin from starchy carbohydrates. Good fat is actually very healthy, but at this particular stage we want to use your body’s subcutaneous fat to fuel your training.

A sample diet for this routine is:

1) A protein shake in water and a piece of fruit

2) Chicken breast salad

3) Protein shake in water and a handful of nuts
